Who you are agreeing with

Ordinary is made and published by Tomáš Zahrádka, business number 04517164, Malířská 9, 170 00 Prague 7, Czech Republic. In this text that is “I”. “The app” is Ordinary, including any build distributed through TestFlight.

This agreement is between you and me. It is not with Apple. Apple is not responsible for the app or for its content.

What you may do with it

Downloading the app gives you a personal, non-exclusive, non-transferable licence to use it on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The licence is to use the app, not to own it. It may also be accessed by other accounts associated with you through Family Sharing or volume purchasing.

You may not sell it on, rent it out, or pass your copy to someone else. You may not take it apart, decompile it or reverse-engineer it, except where the law says you may do so regardless of what this text says.

Ordinary Plus

The app is free and complete as it is. Ordinary Plus is a one-time purchase that unlocks the rest of it: two more ways to use the shutter, four more films, and recipes you can change and name yourself.

It is a purchase, not a subscription. Nothing renews, nothing expires and nothing is charged again. It is tied to the Apple account that bought it, works on every device signed into that account, and is shared with your family group if you use Family Sharing. If it ever fails to appear, Restore purchase in the app asks Apple again.

If Apple refunds the purchase, the paid part locks again. Anything you set up while you had it stays saved and comes back if you buy it again.

Your photographs are yours

Every photograph you take with the app belongs to you. I claim no rights over it, and I never see it: the app has no account, no server and nothing to upload to. Photographs stay on your phone until you move them yourself.

Test builds

When a build is distributed through TestFlight it is unfinished by definition. Builds change, features move, and something that works today may not work tomorrow. Do not rely on a test build for a photograph you cannot take twice.

What the app does not do

The app writes the chosen look into the file as the picture is taken. There is no untouched original underneath and no RAW file. That is deliberate, it is described plainly before purchase, and it cannot be undone afterwards.

Support

Support and maintenance are mine, not Apple’s. Apple has no obligation to provide either. Write to hello@ordinarycamera.com and it reaches the person who wrote the code.

Warranty

The app is provided as it is. Beyond the rights you have under Czech and EU consumer law, which nothing here takes away, I give no warranty that it will be free of faults or fit for a particular purpose.

If the app fails to conform to any warranty that does apply, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind. Any other claim, loss, liability, damage, cost or expense arising from a failure to conform to a warranty is mine to answer for, not Apple’s.

Liability

To the extent the law allows, my liability for any claim connected with the app is limited to the amount you paid for it. I am not liable for lost photographs, lost time or lost opportunities. Nothing here limits liability for death, personal injury, or anything caused deliberately or by gross negligence.

I, not Apple, am responsible for addressing any claim you or a third party make about the app or about your use of it: product liability, any failure to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation.

If someone claims the app infringes their intellectual property, investigating that claim, defending it, settling it and discharging it are mine to handle, not Apple’s.

Where you may use it

By using the app you confirm that you are not in a country subject to a United States government embargo or designated as supporting terrorism, and that you are not on any United States government list of prohibited or restricted parties.

Third parties

You agree to comply with the terms of any third-party service the app relies on. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

Changes

These terms can change when the app changes. The version on this page is the one that applies, and the date at the top says when it started to.

Law

Czech law applies, and the courts of the Czech Republic have jurisdiction. If you are a consumer in the EU, this does not remove the protections of your own country’s law.

Refunds

The App Store sells the app, not me. Refunds are handled by Apple, through the same account you bought it with, and Apple’s policy decides them. Write to me anyway if something went wrong. I would rather know.
